No, thats not correct! OWM makes the first pixel's color the background whether the image is indexed or not. So, there's no work around for this right now.
Thats because OWM treats the first pixel's color (the one in the top left corner) as the background color (transparent). This happens when the image is not indexed and OWM has to index it. A work around would be to manually edit the palette and make that pink color the first one and then import your indexed image. When OWM gets an indexed image it imports its palette the way it is.
If I understood correctly, that's not a bug. OWM doesn't check if an image's palette is similar to an OW already in the game. Whenever you import an OW, a new palette is created for that OW, whether its palette is different, similar or even identical with a palette that's already in.

There is some bytes you need to change, bytes of the ow header. I'm not at my home for some time, so I can't tell you exactly which one :c
just saying but when I open the rom with DNs it pulls out an error and says theres maybe already and outdated DNs installed and some errors and then it closes :I
